-Patricia Schneider - I don’t see a road for the owners to use with the current             egress/ingress?    

-Al MacDonald - This is in dispute at this time with the Schneiders

-Dan - So this right of way continues to be in dispute? Al - Yes.

-Two owners?  Al - Yes.

-Question about access to property?

-Dan - Any access to this property that is not in dispute?

-Al - No.

-If approved now it will be a land lock? (Schneider)

-Al:  Correct, no legal right of way at this time

-Tony:  Where is legal access on this property right now?

-Al:  It is in dispute right now.

-Schneider:  Right away goes right through my sister’s house.

-Does wood trail extend through the land or is that where it ends?

-Al explains the wood trail and where it runs.

-Tony - Where is disputed right away?

-Al explains on map where it is.

-If Melapioni agrees on a right away then there can be a right away besides going through Schneider property.

-Schneider states they were very clear that they were not going to approve this subdivision.

-Dan:  Do we have to go through with subdivision?

-Tal:  No grounds for denial due to new information Al has received that day.

-Dan:  Should this be a long form SEQR due to right away dispute?

-Tal:  Could be due to traffic.

 *9.442 acres being divided into (4.315 acres + 0.405 acres) and (4.317 acres + 0.405 acres)

Open Business:

Silver Spur Development - subdivision

*Has already been before board in 2008

*November 2008 they were in with pie deductions on acreage

*Dispute resolved with Caruso that morning

*Granting of piece and establishment of line has been exempted from subdivision as per the courts, so planning board can make decision.

*Some of this occurred in 2005 or 2006.

*Dan:  We need to find the older folder and combine them.

*Public hearing on January 6, 2010

Dan to the public:  We are going to be asking for underlying subdivision maps from this point on so we can take a look at them.  We want the most recent one prior so we can take a look at it.  If there isn’t one then get an affidavit stating that.

 

Brundage - subdivision

*This was Marschman’s subdivision last year

*4 lots right now - making them 8 lots

*MAJOR SUBDIVISION NEEDED

*Dan gave Gary Harvey copy of fee schedule for him to review and come up with application fee.

Ed:  We put a note in there that there should be no further subdivisions

Ray:  We put that they need to come back before us if they are to divide further.

Gary:  Pretty simple subdivision, I should be ready for public hearing next month.

Ray:  My notes state after five years can do minor subdivision, before five years must be major subdivision

Dan:  If there is nothing wrong with land then there’s no reason why it can’t be subdivided again.

Dan:  Is there a problem with going forward with this if major subdivision?

Ed:  Can you bring a driveway out onto this road for this parcel?  Gary showed Ed where             driveway would be.

*Public hearing for January 6, 2010

 

Deschaine - site plan

*Dan went around the table and asked every board member if they still had concerns with the site plan?

Beth:  Still concerned about the lot size - if there’s enough room to do what is planned.

Tony, Allen, and Ray: Okay with everything

Ed:  Okay as long as DEC, ENCON, and other agencies are involved.

Pete:  Size of lot and topography still bothering him.  Not sure if ledge will give enough room for things planned.

Frank:  Noise and air pollution still bothering him.
